1. Agreement to Terms

Welcome to AI Freedom Club, a product of WIN MASSIVE IMPACT PVT LTD ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website (www.aifreedomclub.com), AI-powered tools, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

2. Eligibility

To use AI Freedom Club, you must:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Services under applicable laws
• Provide accurate and complete information during registration

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account by providing:

• Valid email address
• Full name
• Secure password
• Optional: Phone number for two-factor authentication (2FA)

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password and account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Enabling two-factor authentication (2FA) for enhanced security (recommended)

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. You may also delete your account at any time through your account settings or by contacting support@aifreedomclub.com.

4. Services and Features

4.1 AI-Powered Tools

AI Freedom Club provides access to a suite of AI-powered tools, including but not limited to:

• File converters (PDF, images, videos, audio)
• AI summarizers and generators
• Text analyzers and editors
• Media processors and enhancers
• Document chat and analysis tools

4.2 Service Availability

We strive to provide reliable and uninterrupted access to our Services. However, we do not guarantee:

• 100% uptime or availability
• Error-free operation
• Freedom from viruses or harmful components
• Compatibility with all devices and browsers

We may temporarily suspend access for maintenance, updates, or technical issues. We will notify users of planned maintenance whenever possible.

4.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any feature or tool at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Services.

5. Credit System and Pricing

5.1 Credit-Based Billing

AI Freedom Club operates on a credit-based billing system where:

• 1 credit = $0.0001 USD
• Each tool operation costs a specific number of credits
• Credit costs are displayed before each operation
• Credits are deducted from your balance upon successful tool execution

5.2 Free Tier

Free tier users receive:

• 1,000 credits per day (resets daily at midnight UTC)
• Access to all tools (with usage limits)
• Maximum file size: 10 MB
• File retention: 24 hours
• Standard processing priority

5.3 Paid Tiers

Paid subscriptions offer:

• Monthly credit allocations (no daily reset)
• Higher file size limits (25 MB to 100 MB)
• Extended file retention (7 days)
• Priority processing
• No watermarks or branding

5.4 Credit Purchases

You may purchase additional credits:

• Credits purchased are added to your account immediately
• Purchased credits do not expire (unless account is terminated)
• All purchases are final and non-refundable (except as required by law)
• Unused credits are forfeited upon account deletion

5.5 Pricing Changes

We reserve the right to change credit costs for tools, subscription prices, and credit package prices at any time. Changes will be communicated via email and will take effect immediately for new purchases. Existing subscriptions will continue at the current rate until renewal.

6. Payment and Billing

6.1 Payment Processing

All payments are processed securely through Stripe. We do not store your full credit card details. By providing payment information, you authorize us to charge your payment method for:

• One-time credit purchases
• Recurring subscription fees
• Any applicable taxes or fees

6.2 Subscriptions

Subscription billing works as follows:

• Subscriptions renew automatically on a monthly basis
• You will be charged on the same day each month
• You can cancel your subscription at any time (no refund for current billing period)
• Upon cancellation, you retain access until the end of the billing period
• Unused credits from cancelled subscriptions remain available

6.3 Failed Payments

If a payment fails:

• We will attempt to charge your payment method up to 3 times
• You will receive email notifications of failed payments
• Your subscription may be suspended until payment is successful
• Your account may be downgraded to the free tier after 7 days

You are responsible for paying all applicable taxes, duties, and government fees associated with your use of the Services. Prices displayed do not include applicable taxes unless otherwise stated.

7. User Content and Uploads

7.1 Your Content

You retain all ownership rights to the files and content you upload ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive, royalty-free license to:

• Store and process Your Content to provide the Services
• Use AI models to analyze, convert, or modify Your Content as requested
• Display Your Content to you and authorized users of your account

7.2 Content Restrictions

You may NOT upload content that:

• Violates copyright, trademark, or intellectual property rights
• Contains malware, viruses, or harmful code
• Is illegal, obscene, defamatory, or harassing
• Violates privacy rights or contains personal data without consent
• Promotes violence, hate speech, or discrimination
• Violates export control laws or sanctions

7.3 Content Removal

We reserve the right to remove, suspend access to, or refuse to process any content that violates these Terms or applicable laws. We are not obligated to monitor user content but may do so to ensure compliance.

7.4 File Retention and Deletion

Uploaded files are automatically deleted according to the following schedule:

• Free tier: 24 hours after upload
• Paid tiers: 7 days after upload

After deletion, files are permanently removed and cannot be recovered. You are responsible for downloading and backing up your processed files before the retention period expires.

8. Prohibited Activities

You agree NOT to:

9. Intellectual Property Rights

9.1 Our Intellectual Property

All content, features, and functionality of the Services, including but not limited to:

• Text, graphics, logos, icons, and images
• Software, code, and algorithms
• Tool designs and user interfaces
• Trademarks and service marks

are owned by WIN MASSIVE IMPACT PVT LTD or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Services for personal or internal business purposes
• Download and save output files generated by the Services

This license does not grant you any rights to copy, modify, distribute, sell, or reverse engineer any part of the Services.

9.3 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the Services, you grant us the right to use them without any obligation or compensation to you.

10. Third-Party Services

AI Freedom Club integrates with third-party services to provide our tools, including:

• OpenRouter: AI model routing (for GPT-4, Claude, Gemini, etc.)
• Stripe: Payment processing
• Cloud storage and infrastructure providers

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for:

• The availability, functionality, or performance of third-party services
• The privacy practices or data handling of third-party providers
• Any damages or losses resulting from third-party services

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees of accuracy, reliability, or availability
• Guarantees that the Services will be error-free or uninterrupted

11.2 No Guarantee of Results

We do not guarantee:

• The quality, accuracy, or completeness of AI-generated outputs
• That file conversions will be perfect or error-free
• That processed files will be suitable for your intended purpose
• That the Services will meet your specific requirements

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIN MASSIVE IMPACT PVT LTD SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Costs of substitute goods or services
• Damages arising from your use or inability to use the Services

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100, WHICHEVER IS GREATER.

11.4 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability shall be limited to the maximum extent permitted by law.

13. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

13.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

13.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@aifreedomclub.com to attempt to resolve the dispute informally. We will make a good faith effort to resolve disputes within 30 days.

14. Changes to These Terms

We may update these Terms from time to time. When we make changes:

• We will post the updated Terms on this page
• We will update the "Last Updated" date at the top
• We will notify you via email if changes are material

Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
